1. Agreement to These Terms

These Terms of Service govern your use of foreignwaters.com and your purchase of any Foreign Waters product. By browsing the site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the site or buy from us.

Foreign Waters is a brand operated by Revival Project, Inc., a California corporation, with a mailing address at 25306 Camino De Chamisal, Salinas, California 93908. For customer service, email hello@foreignwaters.com. For legal notices, email gianni@foreignwaters.com. "We," "us," and "our" mean Revival Project, Inc.; "you" means the person using the site or placing the order.

You must be at least 18 years old to buy from us. We currently sell and ship only within the United States and its territories. If you order from outside that area, we may cancel and refund the order.

These Terms work alongside our Privacy Policy and Refund Policy, both of which are part of this agreement. Where the Refund Policy and these Terms disagree about refunds, the Refund Policy controls.

2. Your Account

You do not need an account to order, but you will need one to manage a subscription. If you create one, keep your information accurate and your login details to yourself. You are responsible for everything that happens under your account.

Tell us promptly at hello@foreignwaters.com if you believe someone else has accessed it. We may suspend or close an account we reasonably believe is being used fraudulently, to resell our products, or in breach of these Terms.

3. Products, Pricing and Availability

All prices are in US dollars and exclude tax and any shipping charges, which are shown at checkout before you pay. We may change prices, and may add, change or discontinue products, at any time and without notice. A price change does not affect an order we have already accepted.

We try to describe our products accurately, but packaging, images and colors on the site are approximate, and formulations and label copy can change. The label on the product you receive controls.

If a product or price is listed in error — a typo, a pricing feed fault, an obviously wrong figure — we may cancel the order even after you receive a confirmation, and we will refund you in full. We may also limit quantities per person, per household or per order.

4. Orders and Payment

Your order is an offer to buy. We accept it when we ship, and until then we may decline or cancel it for any lawful reason — stock, suspected fraud, suspected resale, a billing address that does not match, or a shipping destination we do not serve. If we cancel, we refund anything already charged.

By placing an order you authorize us and our payment processor to charge your payment method for the total shown at checkout, including tax and any shipping. For subscriptions, you also authorize the recurring charges described in Section 5.

Sales tax is calculated at checkout based on your shipping address. Payments are processed by Shopify Payments and, where you choose it, Shop Pay or another wallet; we do not store full card numbers ourselves.

5. Subscriptions and Automatic Renewal

Read this section carefully. Our subscriptions renew automatically and charge your payment method until you cancel.

When you buy a subscription, you are enrolling in a recurring order. Before you pay, the checkout page states the amount of your first charge, the amount of each charge after that, and how often charges recur. By completing checkout you consent to those charges.

Intro pricing. Some subscriptions are offered at a promotional price that applies to your first order only. After that first order, the subscription renews at the standard recurring price shown at checkout, which is higher than the intro price. The promotional price does not apply to any renewal.

Billing and delivery frequency. Each subscription option has its own interval — currently monthly, every two months, or every three months, depending on the size you choose. Your card is charged at the start of each interval and the order ships shortly after. The interval you selected appears on the checkout page, in your order confirmation email, and in your account.

Renewal until cancelled. Your subscription continues and your payment method is charged at each interval until you cancel. There is no fixed term and no minimum number of orders unless we say so explicitly at checkout.

How to cancel. You may cancel at any time, for any reason, at no cost, by using the subscription management link in your order confirmation or account, or by emailing hello@foreignwaters.com from the address on the order.

Cancellation takes effect for the next renewal. If a renewal has already been charged and the order has entered fulfilment when you cancel, that order will ship and is handled under our Refund Policy rather than cancelled.

Changes to recurring price. If we change the recurring price of an active subscription, we will notify you by email at least 30 days before the change takes effect, and you may cancel before then.

Failed payments. If a charge is declined, we may retry it and may pause or cancel the subscription. You are responsible for keeping your payment and contact details current.

Your consent record. We will send you an acknowledgement of your subscription terms by email after you enrol, and it will include the cancellation instructions above.

6. Promotions and Discount Codes

Promotions are offered at our discretion and for a limited time. Unless we say otherwise: one discount code applies per order, and codes do not combine with each other or with subscription promotional pricing; a code applies only to orders placed while it is valid, and cannot be applied to an order already placed; a promotional subscription price applies to the first order of that subscription only; and promotions exclude gift cards and may exclude specific products or bundles.

We may withdraw or change a promotion at any time, and we may void a code and cancel the related order where we reasonably believe it was obtained or used improperly — for example through duplicate accounts, resale, or automated tools.

7. Shipping and Delivery

We ship only within the United States and its territories, and we do not accept international orders. Shipping is free on all subscription orders. Shipping charges for one-time orders, where they apply, are shown at checkout.

Delivery dates and transit times shown on the site are estimates, not guarantees, and we are not responsible for carrier delays, weather, or events outside our control. Title and risk of loss pass to you when we hand the package to the carrier.

If your order arrives damaged, or does not arrive, contact us at hello@foreignwaters.com and we will make it right. You are responsible for giving us a complete and correct shipping address; we are not responsible for packages delivered to an address you entered incorrectly.

8. Refunds

First-time purchases are covered by our 60-day money-back guarantee: if the product has been delivered and reasonably tried and you are not satisfied, contact us within 60 days of delivery for a full refund. We offer refunds, not returns — you do not need to ship the product back.

To request a refund, email hello@foreignwaters.com with your order number or proof of purchase. Approved refunds go back to your original payment method, typically within 10 business days, though your bank may take longer to post them.

Gift cards are not refundable.

Our Refund Policy sets out the full terms and controls if anything in this section conflicts with it.

9. Health Disclaimer

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure or prevent any disease.

Foreign Waters products are dietary supplements, not medicines. Information on our site, including the science pages, research summaries, citations and any whitepaper we publish, is provided for general education. It is not medical advice and is not a substitute for advice from a qualified healthcare provider.

Consult your physician before using our products, particularly if you are pregnant or nursing, under 18, taking any medication, or have a medical condition — including cardiovascular conditions, high blood pressure, anxiety disorders, or any condition affected by stimulants. Our products contain paraxanthine, a stimulant. Discontinue use and seek medical attention if you experience an adverse reaction.

Individual results vary. Research findings we cite describe studies of specific ingredients under specific conditions and do not predict what any individual will experience. Statements about performance, focus or energy describe the intended effect of the product's ingredients on normal body structure and function, and are not claims to treat any condition.

Keep out of reach of children. Do not exceed the recommended serving.

10. Intellectual Property and Customer Content

The site and everything on it — text, photography, video, graphics, logos, product names and the Foreign Waters name and marks — belong to us or our licensors and are protected by copyright and trademark law. We grant you a limited, personal, non-transferable licence to view and use the site to shop. You may not copy, reproduce, republish, scrape or use our content commercially without our written permission.

If you submit a review, photo, video, comment or other content to us or about us — including content you send us or post to social media tagging us — you grant us a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, adapt and display it in our marketing, on our site, and in paid advertising, without further permission or payment.

You confirm that content you submit is yours to give, is accurate, reflects your honest experience, and does not infringe anyone else's rights or privacy. We may remove any submission for any reason. We do not pay for reviews or condition them on a positive rating.

11. Acceptable Use and Third-Party Services

You agree not to use the site to break the law, to buy for resale without our written authorization, to interfere with the site's operation or security, to scrape or harvest data, or to introduce malicious code. You agree not to impersonate anyone or misrepresent your affiliation with us.

Our site runs on Shopify and uses third-party services for subscriptions, email, analytics and payments. Those services are operated by companies we do not control and are governed by their own terms and privacy policies. We are not responsible for them, and a link from our site to another site is not an endorsement of it.

12. Disclaimers, Limitation of Liability and Indemnity

Disclaimer. Except for the express guarantee in our Refund Policy and any warranty that cannot be excluded by law, the site and our products are provided "as is" and "as available." We disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

Limitation of liability. To the fullest extent permitted by law, our total liability to you arising out of or relating to these Terms, the site, or any product, for any cause and regardless of the form of action, will not exceed the greater of the amount you paid us for the order giving rise to the claim or one hundred dollars ($100). We will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, even if we were advised such damages were possible.

Nothing in this section limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Some states do not allow the exclusion of certain warranties or the limitation of incidental or consequential damages, so parts of the above may not apply to you.

Indemnity. You agree to indemnify and hold harmless Revival Project, Inc., its officers, employees and agents from any claim, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the site, or content you submit.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Talk to us first. Most problems are solved faster by email. Before starting formal proceedings, contact us at gianni@foreignwaters.com and give us 30 days to resolve the matter.

Courts. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Monterey County, California. You and we consent to the personal jurisdiction of those courts and waive any objection to venue there.

Either of us may instead bring a qualifying individual claim in small claims court.

Nothing in this section prevents either of us from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

14. Changes, Severability and Contact

We may update these Terms from time to time. The current version is always posted at foreignwaters.com/policies/terms-of-service with the date it took effect. Changes apply to orders placed after they are posted. If a change materially affects an active subscription, we will notify subscribers by email.

If any provision of these Terms is held unenforceable, that provision is limited or removed to the minimum extent necessary and the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between us on this subject. You may not assign your rights under them; we may assign ours in connection with a merger or sale of the business.
